TERMS & CONDITIONS

1. INTRODUCTION

Play2Win Social LLC, powering and operating the Afro Haus brand (“Afro Haus,” “Play2Win Social LLC,” “we,” “us,” or “our”), organizes, promotes, coordinates, and facilitates events, destination experiences, entertainment, accommodations, recreational activities, transportation, excursions, nightlife experiences, and related products and services.

Through theafrohaus.com and our authorized booking platforms, customers may purchase event tickets, passes, accommodations, packages, ski and snowboard products, equipment rentals, lessons, transportation, excursions, upgrades, add-ons, merchandise, and other services (collectively, the “Products and Services”).

These Booking Terms & Conditions (“Booking Conditions”) establish the terms governing the purchase and use of Products and Services offered through Afro Haus.

Please read these Booking Conditions carefully. By completing a Booking, making a payment toward a Booking, purchasing a Product or Service, or participating in an Afro Haus Event or Experience, you acknowledge that you have read, understood, and agree to be bound by these Booking Conditions.

Certain portions of an Afro Haus Experience may be provided by independent third parties, including hotels, resorts, venues, transportation providers, equipment rental companies, instructors, activity operators, restaurants, nightlife venues, ticketing platforms, and other suppliers. Additional terms, waivers, rules, and policies imposed by those providers may also apply.

2. DEFINITIONS

For purposes of these Booking Conditions:

“Afro Haus” means the Afro Haus brand and Events and Experiences powered and operated by Play2Win Social LLC.

“Play2Win Social LLC” means the legal entity powering and operating Afro Haus.

“Booking” means a confirmed purchase or reservation for one or more Products and Services.

“Event” or “Experience” means any Afro Haus event, destination experience, party, recreational activity, excursion, gathering, entertainment experience, or related program.

“Lead Booker” means the individual who completes a Booking for themselves or on behalf of other Guests.

“Guest,” “Attendee,” or “Participant” means any individual attending or participating in an Afro Haus Event or Experience.

“You” and “Your” mean the Lead Booker and, where applicable, all Guests included in a Booking.

“Ticket” means any ticket, pass, wristband, QR code, credential, reservation, or other authorization providing access to an Event, Experience, or Product or Service.

“Package” means a combination of Products and Services sold together, which may include Event admission, accommodations, ground transportation, recreational activities, excursions, entertainment, or other components identified at booking.

“Add-On” means an optional Product or Service purchased separately from or in addition to a Ticket or Package.

“Products and Services” means anything offered for purchase through Afro Haus, including Tickets, Packages, accommodations, transportation, activities, equipment rentals, lessons, excursions, upgrades, merchandise, and Add-Ons.

“Supplier,” “Third-Party Provider,” or “Event Partner” means an independent third party providing any portion of an Afro Haus Experience, including hotels, resorts, venues, transportation providers, rental providers, instructors, activity operators, restaurants, nightlife venues, ticketing providers, payment providers, and other vendors.

3. LEGALLY BINDING CONTRACT

3.1 Formation of Contract

A legally binding contract between the Lead Booker and Play2Win Social LLC is formed when we accept your Booking and receive either:

  1. payment in full; or
  2. the initial payment required under an approved payment plan.

An automated acknowledgment does not necessarily constitute acceptance if payment fails, inventory becomes unavailable, fraud is suspected, or an obvious technical or pricing error has occurred.

3.2 Acceptance

By completing a Booking, you confirm that:

  1. You have read and understood these Booking Conditions.
  2. You agree to be bound by them.
  3. You will communicate applicable terms and important Event information to all Guests included in your Booking.
  4. Information you provide is accurate and complete.
  5. You are authorized to provide information relating to other Guests included in your Booking.
  6. You accept financial responsibility for amounts due under your Booking.
  7. You understand that additional Third-Party Provider terms may apply.

3.3 Minimum Age

The Lead Booker must be at least twenty one (21) years old.

Certain Events, venues, activities, accommodations, or Products and Services may have additional age restrictions.

Events advertised as 21+ require all Guests to be at least twenty-one (21) years old.

Valid government-issued photographic identification may be required.

Failure to satisfy an applicable age or identification requirement does not entitle the Guest to a refund.

3.4 Privacy

Personal information associated with a Booking will be processed in accordance with the Afro Haus Privacy Policy available through theafrohaus.com.

4. PRODUCTS & SERVICES

4.1 Products Offered

Afro Haus may offer Products and Services including:

  • Event Tickets and passes;
  • weekend or multi-day passes;
  • hotel accommodations;
  • destination Packages;
  • ski and snowboard access;
  • ski and snowboard equipment rentals;
  • ski and snowboard lessons;
  • tubing;
  • snow play;
  • snowshoeing;
  • excursions;
  • wellness activities;
  • shuttle and ground transportation;
  • nightlife admission;
  • VIP or upgraded experiences;
  • merchandise; and
  • other Add-Ons.

4.2 Booking Inclusions

The Products and Services specifically included in your Booking will be identified at checkout, in your Booking confirmation, or in applicable Event materials.

Anything not expressly identified as included is excluded.

4.3 Third-Party Products

Certain Products and Services are fulfilled by independent Suppliers.

Guests may be required to agree to additional Supplier terms, waivers, safety rules, eligibility requirements, or cancellation policies.

5. PRICING, FEES & PAYMENT

5.1 Currency

Unless otherwise stated, all prices are displayed and charged in U.S. Dollars (USD).

5.2 Fees

Applicable booking, service, processing, platform, resort, activity, transportation, or other fees may be added to a purchase.

Applicable mandatory charges will be disclosed as required by law.

5.3 Third-Party Charges

Guests are responsible for charges imposed directly by third parties unless expressly included in their Booking.

These may include:

  • hotel incidental deposits;
  • parking;
  • food and beverages;
  • equipment damage;
  • room damage;
  • gratuities;
  • optional upgrades;
  • personal transportation; and
  • other incidental expenses.

5.4 Price Changes

Prices may increase or decrease before purchase because of demand, availability, inventory, Supplier pricing, promotions, or other factors.

You are not generally entitled to a refund, credit, or adjustment because the same or similar Product or Service is later offered at a different price.

5.5 Pricing Errors

Afro Haus reserves the right to correct obvious typographical, technical, or pricing errors.

If a material pricing error affects a Booking, we may offer you the opportunity to pay the correct price or cancel the affected Product or Service and receive an applicable refund.

5.6 Payment Verification

All transactions may be subject to payment verification, fraud screening, and security checks.

We may cancel a Booking where payment cannot be verified or where we reasonably suspect unauthorized or fraudulent activity.

6. PAYMENT PLANS

6.1 Payment Plan Agreement

Where offered, customers may select an installment payment plan.

By selecting a payment plan, you authorize charges according to the payment schedule presented during checkout.

6.2 Payment Responsibility

The Lead Booker remains responsible for the full outstanding Booking balance.

6.3 Failed Payments

If an installment payment fails, we or our payment provider may attempt to process the payment again and may request updated payment information.

6.4 Default

If an outstanding payment remains unpaid after reasonable collection attempts, Afro Haus may cancel some or all of the Booking.

Except where otherwise expressly stated or required by applicable law, amounts already paid toward a Booking cancelled because of payment default are non-refundable.

6.5 Completion of Payment

Afro Haus may withhold final Tickets, vouchers, hotel information, activity credentials, or other Booking benefits until the required balance has been paid.

7. REFUNDS & NON-REFUNDABLE SALES

7.1 General Policy

Unless a different cancellation policy is expressly presented during checkout or required by applicable law, Event Tickets, admissions, activities, Add-Ons, and other Products and Services are final, non-refundable, and non-exchangeable after purchase.

7.2 Personal Circumstances

Refunds will generally not be provided because of:

  • change of mind;
  • inability to attend;
  • work or personal scheduling conflicts;
  • missed flights;
  • flight delays or cancellations;
  • personal transportation issues;
  • missed shuttles;
  • late arrival;
  • failure to obtain required identification;
  • illness or injury unless otherwise required by law or covered by an applicable protection product;
  • weather that does not result in cancellation of the applicable Product or Service;
  • dissatisfaction with snowfall or mountain conditions;
  • failure to participate in an included activity;
  • removal for Guest misconduct; or
  • failure to use part of a Package.

Nothing in these Booking Conditions eliminates rights that cannot legally be waived.

8. DISPUTES & CHARGEBACKS

8.1 Contact Us First

If you believe there is an issue with a transaction, Booking, or Product or Service, please contact Afro Haus at Support@theafrohaus.com so we have an opportunity to investigate and resolve the matter.

8.2 Chargeback Rights

Nothing in these Booking Conditions restricts any chargeback, consumer-protection, or payment rights that cannot legally be waived.

8.3 Fraudulent Chargebacks

Knowingly submitting a false, fraudulent, or materially misleading chargeback is prohibited.

8.4 Chargeback Defense

Where a dispute is initiated, Play2Win Social LLC may provide relevant documentation to the applicable bank or payment processor, including:

  • Booking confirmations;
  • transaction records;
  • acceptance of these Booking Conditions;
  • correspondence;
  • Ticket scans;
  • attendance information;
  • payment-plan records; and
  • evidence that Products or Services were provided.

9. TICKETS & VOUCHERS

9.1 Delivery

Tickets, vouchers, wristbands, or other credentials may be delivered by email, online account, QR code, mobile platform, physical credential, or onsite collection.

9.2 Customer Responsibility

You are responsible for providing accurate contact information and monitoring your email, spam folder, Booking account, and other communication channels.

9.3 Failure to Receive Tickets

If you believe you should have received a Ticket or voucher but have not, contact Support@theafrohaus.com promptly.

9.4 Verification

Guests must review Tickets when received and promptly report material errors.

9.5 Lost, Stolen, or Compromised Tickets

Lost, stolen, shared, copied, or compromised Tickets may not be replaceable.

9.6 First Valid Scan

Once a Ticket has been validly scanned, redeemed, activated, or exchanged for a wristband or credential, it will generally be treated as used.

9.7 Identification

Afro Haus, a venue, or Supplier may require valid government-issued photographic identification.

10. RESALE & COMMERCIAL USE

Tickets and Packages may not be purchased primarily for unauthorized commercial resale.

Without written permission from Play2Win Social LLC, Afro Haus Tickets or Packages may not be used for:

  • advertising;
  • promotions;
  • contests;
  • sweepstakes;
  • giveaways;
  • unauthorized hospitality packages;
  • unauthorized travel packages; or
  • other commercial purposes.

We may cancel Tickets obtained through prohibited resale or fraudulent activity where permitted by law.

11. NAME CHANGES & TRANSFERS

11.1 Permitted Changes

Where permitted, the Lead Booker may request a name change or transfer of an unused Ticket.

11.2 Administrative Fees

Name changes or transfers may be subject to an administrative fee disclosed before processing.

11.3 Supplier Restrictions

Some hotel, resort, activity, transportation, or other Supplier reservations may prohibit transfers or name changes.

11.4 Used Tickets

Tickets that have already been scanned, redeemed, activated, or exchanged for credentials cannot be transferred.

11.5 Requests

Name-change and transfer requests should be submitted to Support@theafrohaus.com unless another process is communicated for the applicable Event.

12. PACKAGE BOOKINGS

This section applies where Afro Haus offers a combination of Products and Services as a Package.

12.1 Package Components

Packages may include combinations of:

  • Event admission;
  • hotel accommodations;
  • shuttle transportation;
  • ski or snowboard access;
  • equipment rentals;
  • lessons;
  • tubing;
  • snow activities;
  • excursions;
  • nightlife;
  • wellness experiences; and
  • other advertised inclusions.

12.2 Package Description

Your Booking confirmation and applicable Event materials will identify the components included in your Package.

12.3 Independent Travel

Unless expressly identified as included, transportation to and from the Event destination—including airfare—is your responsibility.

Afro Haus is not responsible for independently booked airfare, rental vehicles, or other travel arrangements except where applicable law provides otherwise.

13. ACCOMMODATION

13.1 Hotel Assignment

Your Booking will identify the hotel, room category, occupancy, dates, or applicable hotel-allocation process.

13.2 Hotel Substitution

Where reasonably necessary, Afro Haus may substitute accommodations with another property of a reasonably comparable standard, subject to applicable law.

13.3 Images

Hotel and room photographs are illustrative and may not depict the exact room assigned.

13.4 Check-In

Guests must comply with hotel check-in, identification, occupancy, and check-out requirements.

13.5 Incidentals & Deposits

Hotels may require a credit or debit card, security deposit, or incidental authorization at check-in.

Unless expressly stated otherwise, these amounts are not included in your Afro Haus Package.

13.6 Damage

Guests are financially responsible for damage, excessive cleaning, missing property, smoking charges, or other costs caused by themselves or members of their party.

13.7 Conduct

Serious misconduct may result in removal from accommodations.

Examples include:

  • violence;
  • threats;
  • significant disturbances;
  • property damage;
  • harassment;
  • unauthorized parties;
  • illegal activity; and
  • repeated violation of hotel policies.

Removal because of Guest misconduct does not entitle the Guest to a refund.

14. SKIING, SNOWBOARDING & WINTER ACTIVITIES

14.1 Inherent Risks

Skiing, snowboarding, tubing, snowshoeing, snow play, and other mountain activities involve inherent risks.

These may include:

  • falls;
  • collisions;
  • changing terrain;
  • ice;
  • snow conditions;
  • weather;
  • elevation;
  • equipment;
  • natural obstacles;
  • man-made obstacles; and
  • interaction with other participants.

Participation is voluntary.

14.2 Resort Terms & Waivers

Resorts and activity operators may require Guests to accept additional rules, releases, waivers, rental agreements, or safety conditions.

14.3 Ability

Guests are responsible for choosing activities appropriate for their ability, experience, and physical condition.

14.4 Resort Operations

Afro Haus does not control:

  • snowfall;
  • snowmaking;
  • trail openings;
  • lift operations;
  • terrain availability;
  • avalanche mitigation;
  • wind holds;
  • mountain closures;
  • resort operating hours; or
  • other resort operational decisions.

15. EQUIPMENT RENTALS & LESSONS

15.1 Equipment

Equipment rentals may be provided by independent Suppliers.

Guests must comply with applicable rental agreements.

15.2 Lost or Damaged Equipment

Guests may be financially responsible for lost, stolen, or damaged rental equipment according to the applicable Supplier’s terms.

15.3 Lessons

Lesson times, instructor assignments, class sizes, meeting locations, and other operational details may be determined by the applicable resort or instruction provider.

16. TUBING, SNOW PLAY & EXCURSIONS

Activities such as tubing, snowshoeing, snow play, sightseeing, and other excursions may be operated by independent Suppliers.

Participation may be subject to:

  • age restrictions;
  • height or weight restrictions;
  • capacity;
  • weather;
  • operating conditions;
  • waivers;
  • safety requirements; and
  • Supplier rules.

Afro Haus cannot guarantee operation of an activity where weather, safety, capacity, or Supplier conditions prevent it.

17. SHUTTLES & GROUND TRANSPORTATION

17.1 Pickup

Guests must arrive at designated pickup locations by the communicated time.

17.2 Late Guests

Transportation providers are not required to delay departure for late Guests.

17.3 Missed Transportation

Guests who miss transportation may be responsible for arranging and paying for alternative transportation.

17.4 Delays

Transportation may be delayed because of:

  • snow;
  • traffic;
  • chain controls;
  • road closures;
  • accidents;
  • weather;
  • mechanical issues; or
  • circumstances outside our reasonable control.

Published transportation times are estimates and are not guaranteed.

17.5 Conduct

Transportation may be refused to Guests whose behavior creates a reasonable safety concern.

18. NIGHTLIFE & HOSPITALITY EVENTS

18.1 Admission

Admission to nightlife Events is subject to the applicable venue’s rules and legal requirements.

18.2 Age Restrictions

Certain Events may be strictly 21+.

18.3 Identification

Valid government-issued photographic identification may be required.

18.4 Intoxication & Conduct

Afro Haus and applicable venues may refuse admission or remove Guests who are excessively intoxicated, violent, threatening, disruptive, or otherwise create a reasonable safety concern.

18.5 Venue Requirements

A Ticket does not override lawful:

  • identification requirements;
  • security procedures;
  • capacity restrictions;
  • dress requirements where applicable; or
  • other venue admission policies.

No refund will be provided when admission is denied because of Guest misconduct or failure to satisfy a clearly communicated requirement.

19. EVENT TIMINGS, ARTISTS & PROGRAMMING

19.1 Event Times

Advertised schedules and Event times are subject to change.

19.2 Artists, DJs & Hosts

Artists, DJs, hosts, performers, and programming are subject to change.

19.3 Program Alterations

Cancellation, replacement, or rescheduling of a particular performer, DJ, host, activity, or attraction does not automatically constitute cancellation of the overall Event.

19.4 Venue Changes

Afro Haus may change Event locations where reasonably necessary.

Material changes will be handled in accordance with applicable law and these Booking Conditions.

20. ADMISSION & SECURITY

Guests may be subject to:

  • identification checks;
  • Ticket scans;
  • bag inspections;
  • security screening;
  • wristband verification; and
  • other lawful security procedures.

Afro Haus and applicable venues may refuse admission or remove Guests where reasonably necessary for safety, security, legal compliance, or enforcement of these Booking Conditions.

21. GUEST CONDUCT

Guests are expected to behave safely and respectfully.

Prohibited conduct includes:

  • violence;
  • threats;
  • harassment;
  • discriminatory abuse;
  • dangerous behavior;
  • severe intoxication creating a safety risk;
  • prohibited weapons;
  • illegal substances;
  • deliberate property damage;
  • fraudulent credentials;
  • unauthorized commercial activity; and
  • refusal to follow lawful safety instructions.

Removal due to Guest misconduct does not entitle the Guest to a refund.

22. PROHIBITED ITEMS

Prohibited items vary by venue and Supplier.

They may include:

  • weapons;
  • explosives;
  • illegal substances;
  • dangerous objects;
  • drones;
  • unauthorized professional recording equipment; and
  • outside alcohol.

Applicable venue restrictions will control.

23. ALCOHOL

Alcohol may be available through licensed third-party venues or vendors.

Guests must comply with applicable alcohol laws.

Guests must be at least twenty-one (21) years old to purchase or consume alcohol in the United States.

Valid government-issued identification may be required.

Licensed venues and vendors may refuse alcohol service where required or permitted by law.

24. ACCESSIBILITY

Afro Haus aims to provide inclusive Experiences and will work with venues and Event Partners regarding reasonable accessibility accommodations.

Accessibility may vary among hotels, mountain resorts, vehicles, nightlife venues, and outdoor recreational activities.

Guests requiring accommodations should contact Support@theafrohaus.com sufficiently in advance so available options can be discussed.

Some accommodations may depend on physical infrastructure, safety requirements, Supplier availability, and capacity.

Nothing in these Booking Conditions limits rights available under applicable disability-access laws.

25. HEALTH & PARTICIPATION

Guests are responsible for determining whether they are physically capable of participating in an activity.

Afro Haus Experiences may involve:

  • high elevation;
  • cold temperatures;
  • snow and ice;
  • extended walking;
  • skiing or snowboarding;
  • physical exertion;
  • loud music;
  • crowds;
  • alcohol; and
  • late-night activities.

Guests must follow reasonable safety instructions from Afro Haus, venues, resorts, transportation providers, and activity operators.

26. PHOTOGRAPHY, VIDEO & EVENT MEDIA

Afro Haus Events may be photographed, filmed, recorded, or livestreamed.

To the extent permitted by law, by attending an Afro Haus Event you acknowledge that you may appear incidentally in crowd footage, Event photography, recap content, or similar recordings.

Afro Haus and Play2Win Social LLC may use Event media for legitimate purposes including:

  • Event promotion;
  • advertising;
  • social media;
  • website content;
  • Event recaps; and
  • archival purposes.

Where additional consent is legally required for a particular use, appropriate consent will be obtained.

27. WEATHER & SNOW CONDITIONS

Afro Haus destination Events may occur in mountain environments where weather can change rapidly.

Snowstorms, limited snowfall, rain, wind, icy conditions, road conditions, temperature, or limited mountain terrain do not automatically constitute cancellation of an Event.

Specific activities may be delayed, modified, relocated, substituted, or cancelled by Suppliers for safety or operational reasons.

Where reasonably possible, Afro Haus may substitute an affected activity with a reasonably comparable alternative.

28. EVENTS BEYOND OUR REASONABLE CONTROL

Afro Haus and Play2Win Social LLC will not be responsible for failure or delay caused by circumstances outside our reasonable control to the extent permitted by law.

Such circumstances may include:

  • severe weather;
  • wildfire;
  • earthquake;
  • flood;
  • avalanche danger;
  • road closures;
  • government orders;
  • public-health emergencies;
  • epidemics or pandemics;
  • terrorism or credible threats;
  • civil unrest;
  • strikes;
  • widespread transportation disruption;
  • utility failure;
  • venue closure;
  • major infrastructure failure; or
  • comparable circumstances beyond our reasonable control.

Afro Haus may modify, relocate, substitute, postpone, reschedule, or cancel affected Products and Services.

29. CANCELLATION BY AFRO HAUS

If Afro Haus cancels an entire Event and does not provide a rescheduled or substantially equivalent alternative, purchasers may be entitled to a refund of amounts paid directly to Afro Haus for the cancelled Product or Service, subject to applicable law.

Afro Haus and Play2Win Social LLC are not responsible for independently arranged expenses such as:

  • airfare;
  • rental vehicles;
  • separate hotel reservations;
  • clothing;
  • personal equipment; or
  • other incidental costs,

except where applicable law provides otherwise.

If only one component of a Package is cancelled, Afro Haus may provide an appropriate substitute, replacement, credit, partial refund, or other remedy depending upon the circumstances and applicable law.

30. CANCELLATION BY YOU

Cancellation requests must be submitted by the Lead Booker to Support@theafrohaus.com unless another cancellation process is expressly provided for the applicable Booking.

Unless an Event-specific or Package-specific cancellation policy expressly states otherwise, the non-refundable provisions of these Booking Conditions apply.

Failure to attend does not constitute cancellation by Afro Haus.

31. POSTPONEMENT & RESCHEDULING

If an Event is postponed or rescheduled, existing Tickets will generally remain valid for the replacement Event unless Afro Haus communicates otherwise.

Afro Haus will communicate available options after replacement Event details have been confirmed.

Applicable refund, transfer, or credit rights relating to a materially rescheduled Event will be determined according to applicable law and any Event-specific policy.

32. PACKAGE CHANGES

Afro Haus may occasionally need to change part of a Package because of Supplier availability, weather, safety, or operational circumstances.

Changes may include:

  • hotel substitutions;
  • transportation changes;
  • activity schedule changes;
  • activity-provider substitutions;
  • venue changes;
  • lesson changes; and
  • itinerary adjustments.

Where reasonably possible, Afro Haus will provide a reasonably comparable alternative.

Material changes will be handled in accordance with applicable law.

33. CHANGES REQUESTED BY YOU

The Lead Booker may request changes to a Booking by contacting Support@theafrohaus.com.

Afro Haus will attempt to assist but cannot guarantee that a requested change can be made.

Approved changes may be subject to:

  • administrative fees;
  • Supplier fees;
  • increased hotel costs;
  • transportation costs;
  • activity price differences; and
  • other incremental expenses.

Changes are not effective until confirmed by Afro Haus.

34. GROUP BOOKINGS

Group pricing may depend on:

  • party size;
  • room occupancy;
  • transportation capacity;
  • activity reservations; and
  • other Package components.

If a Guest leaves a group Booking, the remaining Guests may be responsible for resulting price increases.

For example, if a Package was priced based on four Guests sharing a room and the group is reduced to three, the per-person accommodation price may change.

The Lead Booker is responsible for communicating Booking information to all members of the group.

35. THIRD-PARTY SUPPLIERS

Afro Haus works with independent businesses to provide portions of its Experiences.

These may include:

  • hotels;
  • ski resorts;
  • Event venues;
  • transportation providers;
  • rental providers;
  • instructors;
  • activity operators;
  • nightlife venues;
  • restaurants;
  • ticketing providers;
  • booking platforms; and
  • payment processors.

Suppliers may impose their own terms, waivers, operating rules, eligibility requirements, and cancellation policies.

Guests agree to comply with applicable Supplier requirements.

Nothing in this section excludes responsibilities that Play2Win Social LLC cannot lawfully exclude.

36. WARRANTIES & CUSTOMER RESPONSIBILITIES

You represent and warrant that information supplied in connection with your Booking is accurate and complete.

You agree to comply with:

  • these Booking Conditions;
  • applicable laws;
  • venue policies;
  • Supplier terms; and
  • reasonable safety instructions.

You are responsible for your conduct and, where legally applicable, damage you cause.

37. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Play2Win Social LLC, Afro Haus, and their applicable representatives will not be liable for indirect, incidental, special, or consequential losses resulting from circumstances outside their reasonable control.

Afro Haus is not responsible for losses caused solely by:

  • your own acts or omissions;
  • unrelated third parties;
  • your failure to follow applicable instructions;
  • independently arranged travel;
  • missed transportation caused by your late arrival; or
  • circumstances outside our reasonable control.

Nothing in these Booking Conditions excludes or limits liability for fraud, willful misconduct, or any other liability that cannot legally be excluded or limited.

38. PERSONAL PROPERTY

Guests are responsible for their personal belongings.

Afro Haus is not responsible for lost, stolen, misplaced, or damaged personal property except to the extent liability cannot legally be excluded.

Lost-property procedures may be administered by the applicable hotel, resort, venue, transportation provider, or other Supplier.

39. WEBSITE & BOOKING PLATFORM

We make reasonable efforts to maintain accurate information on theafrohaus.com and our authorized booking platforms.

Technical interruptions or errors may occasionally occur.

If you submit payment information but do not receive a Booking confirmation, you should verify whether your transaction was completed before attempting another purchase.

40. FRAUD & AUTOMATED PURCHASING

The unauthorized use of bots, scripts, automated purchasing software, fraudulent identities, stolen payment information, or other methods designed to circumvent purchase restrictions is prohibited.

Afro Haus may cancel Bookings reasonably determined to involve fraudulent or unauthorized activity.

41. INTELLECTUAL PROPERTY

The Afro Haus name, logos, Event names, graphics, designs, photography, video, website content, marketing materials, and other proprietary content may be protected by copyright, trademark, and other intellectual-property laws.

You may not commercially reproduce, distribute, modify, sell, license, or otherwise exploit Afro Haus intellectual property without prior written authorization from Play2Win Social LLC.

42. CALIFORNIA SELLER OF TRAVEL

Certain Packages or Products and Services offered through Afro Haus may constitute travel services under California law.

Where applicable, Play2Win Social LLC will comply with California Seller of Travel requirements applicable to the Products and Services it offers.

California Seller of Travel Registration Number: #2170019-40

Registration as a Seller of Travel does not constitute approval by the State of California.

Where required, additional disclosures applicable to travel-related Bookings will be presented during the booking process or in applicable Booking documentation.

43.2 Problems During an Experience

If you experience a problem during an Afro Haus Event or Experience, you should notify Afro Haus, an applicable Event representative, or the responsible Supplier as soon as reasonably possible so there is an opportunity to address the issue.

43.3 Formal Complaints

Formal complaints should include:

  • your full name;
  • Booking reference;
  • applicable Event;
  • description of the issue;
  • relevant dates; and
  • supporting information where appropriate.

44. GOVERNING LAW & JURISDICTION

These Booking Conditions are governed by the laws of the State of California, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Any dispute arising from or relating to these Booking Conditions, a Booking, or an Afro Haus Product or Service will be handled in accordance with applicable law.

Nothing in these Booking Conditions prevents a consumer from exercising rights or remedies that cannot legally be waived.

45. SEVERABILITY

If any provision of these Booking Conditions is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary.

The remaining provisions will continue in full force and effect.

46. NO WAIVER

The failure of Play2Win Social LLC or Afro Haus to immediately enforce any provision of these Booking Conditions does not constitute a waiver of the right to enforce that provision later.

47. CHANGES TO THESE BOOKING CONDITIONS

Play2Win Social LLC may update these Booking Conditions from time to time.

The version applicable to your purchase will generally be the version presented or made available when you completed your Booking, except where a later change is required by law or expressly agreed between the parties.

The current version will be available through theafrohaus.com.

48. ENTIRE AGREEMENT

These Booking Conditions, together with:

  • your Booking confirmation;
  • applicable Event-specific terms;
  • the Afro Haus Privacy Policy;
  • applicable cancellation policies;
  • applicable Supplier terms; and
  • additional terms expressly presented during checkout

constitute the agreement governing your Booking.

Where an Event-specific term expressly conflicts with these general Booking Conditions, the Event-specific term will control for that particular Product or Service to the extent of the conflict.
